There has been some recent discussion from a few homeowners, on the responsibility of maintaining Ditches and Swales. I thought communicating our Declaration of Restrictions reference to this topic would assist the understanding.
Declaration of Restrictions document: #7, General Prohibitions, I
"It shall be the duty of the owner on every lot in the Development on which any part of any open storm drainage ditch or swale is situated to keep such portion thereof as may be situated upon the lot continuously unobstructed and in good repair, and to provide for the installation of such culverts upon said lot as may be reasonably necessary to accomplish the purposes of this subsection. All owners, if necessary, shall install dry culverts between the road rights-of-way and their lots in conformity with specifications and recommendations of the Town of Fishers, Hamilton County, Indiana, and of the appropriate zoning bodies."
